A refund offer can look generous until the owner discovers that part of it goes to a lender. Another offer can look too low because the calculation leaves out a recoverable charge. Understanding the separate components helps a driver ask better questions before accepting a figure.
The example below is hypothetical. It illustrates the arithmetic for an assumed qualifying purchase, not the value of a particular claim. Eligibility, disputed charges and the governing procedure require their own assessment.
Start With The Contract, Not The Monthly Payment
An owner researching a lemon law refund should first collect the signed sales contract, payment history and current lender information. The monthly instalment alone does not show the vehicle price, financing charges, taxes or outstanding debt.
Keep a second folder for expenses linked to the defect. A towing receipt should identify the service and date. A rental invoice should show the rental period and amount actually paid. A card statement may confirm payment but leave the expense’s reason unclear.
California’s statutory restitution provisions identify the actual price paid or payable, specified collateral charges and qualifying incidental damages. They also provide a use deduction. Not every dealer add-on belongs in the calculation, and not every expense an owner experienced is recoverable.
A Worked Example With Visible Assumptions
Assume a new vehicle’s eligible price, including manufacturer-installed options and transportation, is $40,000. For simplicity, assume zero delivery mileage and 6,000 miles driven before the first qualifying repair presentation. Also assume the following charges have been verified as recoverable and do not overlap.
Component Illustrative Amount
Eligible vehicle price $40,000
Sales or use tax $3,600
Eligible official fees $500
Recoverable finance charges $800
Qualifying incidental expenses $300
Subtotal before use deduction $45,200
These figures are assumptions, including the tax amount. They are not a quotation, a tax-rate estimate or a typical settlement. The subtotal also excludes civil penalties and attorney’s fees, which should not be added automatically to a consumer refund estimate.
Calculate The Mileage Deduction Separately.
Using the assumed eligible price and mileage, the illustrative calculation is:
$40,000 × 6,000 ÷ 120,000 = $2,000.
Subtracting that amount from the $45,200 subtotal produces an illustrative net restitution amount of $43,200.
The relevant mileage is tied to the first delivery for correction of the problem giving rise to the nonconformity. It is not automatically the mileage when the owner decided to contact a lawyer. The delivery record and first relevant repair order therefore deserve careful comparison.
The Judicial Council’s civil jury instructions on vehicle restitution, including CACI 3241, also provide guidance on price components and use-value calculations. Counsel should check the applicable instruction and law against the transaction rather than assuming an online calculator handles every issue.
Separate Total Restitution From The Owner’s Payment
Now assume the verified lender payoff is $25,000. If that amount is paid to the lender from the illustrative $43,200 total, the remaining amount is $18,200 for the owner. Together, the two payments equal the same total. The payoff is not an additional $25,000.
This distinction prevents double counting. Down payments and instalments may be relevant evidence of what was paid, but adding them again to a calculation that already includes the full eligible price can inflate the result. Ask for a reconciliation showing where each dollar appears once.
Review Exclusions And Unresolved Items.
Dealer-installed products, separately purchased service contracts, negative equity, and later account changes can complicate calculations. Flag them for individual review. Do not assume a product is included simply because it appears on the same sales contract.
Leased vehicles also need a transaction-specific analysis. A purchase example should not be reused unchanged for a lease. Keep the lease agreement, payment records and any proposed allocation together so the figures can be checked against the correct obligations.
Before responding to an offer, request an itemized explanation of the price base, mileage numerator, fees, expenses, deductions and lender allocation. Match each item to a document. Treat unexplained adjustments as questions for review rather than numbers copied into the final estimate.
Keep the date of every figure visible. A lender statement from last month and a current payment record may describe different balances. When an updated document arrives, retain the earlier version so the reason for a change can be traced. Clear dates also help distinguish a genuine adjustment from an arithmetic error or an omitted payment.
